Guidelines of the Committee of Ministers to member States on the prevention and remedying of violations of the Convention for the protection of human rights and fundamental freedoms (Adopted by the Committee of Ministers on 27 September 2022 at the 1444th meeting of the Ministers’ Deputies)
“These guidelines seek to support the 46 Council of Europe member States in their efforts to comply with their obligation under the European Convention on Human Rights to secure to everyone, within their jurisdiction, the rights and freedoms defined in the Convention.
The guidelines include a number of measures aimed at preventing violations of the Convention at the national level, such as awareness-raising of, and training on, the Convention system, verification of compliance of domestic legislation and administrative practice with the Convention as well as stronger involvement of Parliaments, national human rights institutions and civil society organisations in the implementation of the Convention at the national level.
As regards remedying violations found by the European Court of Human Rights, the guidelines recommend, inter alia, that member States improve their domestic capacities for the effective execution of judgments and decisions of the European Court of Human Rights in all cases to which they are parties, ensure a prompt and effective dissemination to relevant actors of all judgments and decisions of the Court that they are obliged to execute, and promote stakeholder participation in the execution process.”
